Terms of Service

The short version

Using zaions.com is free and needs no account. A project starts from a written estimate you accept. At handover, you own everything you paid for. Payments aren’t refunded, and the laws of Pakistan apply.

Who are these terms between?

You and Zaions, a privately held software agency in Lahore, Pakistan. They cover zaions.com, the Zaions Android app, and the work we do for you. If you send a brief on behalf of a company, you’re confirming you can speak for it.

The Privacy Policy says what we keep about you and for how long.

How may I use the site?

• Use the site lawfully. Don’t try to break into it, overload it, or send briefs automatically.
• The site’s text, design, logo and screenshots belong to Zaions, apart from names and marks that belong to others.
• Our open-source tools and packages come under the license in each one’s own repository.
• Links to our products and to other sites lead to places with their own terms, and Try it here loads a product’s own site inside the page, under that product’s terms.

Sending a brief or booking the free consultation costs nothing and commits you to nothing. Nothing is built until you say go.

What about comments in the Android app?

The Zaions Android app and the earlier zaions.com let you sign in with Google and post comments. A comment stays yours. By posting it, you let us show it in the app and on the site, and we may remove a comment that’s abusive, spam, or someone else’s work. Deleting your account removes your comments; Account deletion says how.

How does a project start?

1. You send the brief.
2. We send a written plan and estimate: the plan, the price, the payment schedule, the first milestone and the running costs, all before we write a line of code.
3. You accept it in writing. Your accepted estimate and these terms are our agreement for that project.

For your project, the figures in your accepted estimate (the price, the payment schedule and the running costs) are the ones that apply.

We re-estimate a change in scope in writing before we build it, so the price never moves without you agreeing.

The milestones in an estimate are a plan, not a promised date. We don’t promise launch dates, store approval, search rankings or sales.

How do payments work?

Your estimate sets the payment schedule. The payment methods are on our Payments page; add the reference from your invoice to each payment. If your invoice and the Payments page ever show different details, use the invoice.

Running costs are listed in your estimate, separate from the price. They’re billed to your own accounts, and they continue after handover.

Are payments refunded?

No. Payments for our work are not refunded, including payments for milestones that are under way or delivered.

If a bank or a payment provider returns a payment by itself, for example through a chargeback, the work time that payment paid for ends.

Payments that aren’t due yet are a different case: “Can I stop a project?” below says what happens to them.

Can I stop a project?

Yes, at any point. Tell us in writing.

Payments for milestones already started or delivered stay paid. A scheduled payment for work not yet started is canceled and never charged. We hand over the work those payments covered, in the same way as a full handover.

Team package: Cancel any time; the package runs to the end of the month you paid for.

Who owns the work?

You own everything you paid for. At handover we transfer the repository, the design files, the store and hosting accounts and every credential into your name, as a standard term in every package.

You can bring your own hosting and service accounts from the start. If you’d rather not, we set up test accounts for your project and share them with you from day one, logins included; you can replace any of them with your own at any point. A public store listing always ships from your own developer account.

Open-source code inside your product keeps its own license. Client work stays private unless the client asks us to show it.

What are we responsible for?

The site and its content are provided as they are. We work carefully, but we can’t promise the site will always be available or free of errors.

To the extent the law allows, our total liability for a project is limited to what you paid us for that project, and neither of us is liable to the other for indirect losses, such as lost profits.

Which law applies?

The laws of Pakistan. Any dispute goes to the courts of Lahore. If something goes wrong, email hi@zaions.com first, so we can try to fix it.

If a court finds one clause unenforceable, the rest still apply.

What happens when these terms change?

The date at the top changes, and the new terms apply from that date. A change doesn’t alter an estimate you’ve already accepted.
